Bill Seeks to Expand Right to Religious Expression at Work

Representative Mark Souder of Indiana has written a bill called the Workplace Religious Freedom Act. Under this Act, companies would have to prove that allowing religious expression on the job entails difficulty or expense for their company. Souder's bill comes in response to his concern that the Supreme Court interpretation of existing workplace religious freedom laws enables companies to deny expression of employees' religious rights. Some examples he cites include denying a Jewish worker time off on holy days or forcing pharmacists to dispense morning after pills, even when it goes against the individual's religion.

In 1972, Congress amended Title VII of the Civil Rights Act of 1964 to protect religious observance at work unless it presented "undue hardship" to employers. Subsequent Supreme Court rulings, however, have allowed limiting rights based on minimal cost or inconvenience to the employer. Souder thinks it has become too easy for employers to deny all religious expression at work and wants to see changes.

Employers are wary that the bill will change the definition of what a reasonable accommodation is, making it difficult to draw the line. Supporters say that there should be a balance and that religious expression should not hinder work and vice versa.

The bill is unlikely to pass this year, but it has gained 18 bipartisan co-sponsors and was given a hearing on Capitol Hill. The increase in multiculturalism and deepening spiritualism in the United States seem to suggest that the issue will continue to gain momentum.
